The Department for Education (DfE) implemented important amendments to legislation surrounding holidays in term time. As of the 1st September 2013, the new law does not give any entitlement to parents to take their child on holiday during term time. Any applications for leave of absence must be in exceptional circumstances and the Head Teacher must be satisfied that the circumstances warrant the granting of leave.

Our school policy defines an “authorised absence” as:

  • An absence for sickness for which the school has granted leave.

  • Medical or dental appointments which unavoidably fall during school time, for which the school has granted leave.

  • Religious or cultural observances for which the school has granted leave.

  • An absence due to a family emergency.

Our school policy defines an “unauthorised absence” as:

  • Parents keeping children off school unnecessarily or without reason.

  • Truancy before or during the school day.

  • Absences which have never been properly explained.

  • Arrival at school after the register has closed.

  • Shopping, looking after other children or birthdays.

  • Day trips and holidays in term-time which have not been agreed.

  • Leaving school for no reason during the day.

Parents may be fined by the Local Authority for taking their child on holiday during term time without consent from the school. Unless there are exceptional circumstances, the Local Authority may issue FPN's for any unauthorised absence of 5 consecutive school days (10 sessions) or more during term time. 

Should an unauthorised absence take place the school will inform the Local Authority and a Fixed Penalty notice will then be issued in accordance with section 444 of the Education Act 1996.

The law stipulates that the current penalties payable by parents/carers are £60 per child when the penalty is paid within 21 days, increasing to £120 when the penalty is paid within the next 7 days (giving a total of 28 days to pay). This penalty is per parent/ carer per child during the duration of the absence.
